Welcome to TembusCV. These Terms & Conditions ("Terms") govern your use of the TembusCV platform operated by TembusCV ("we", "us", or "our"). By accessing or using our service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our service.

1. Acceptance of Terms

By creating an account, uploading CVs, submitting job applications, or using any feature of TembusCV, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions alongside our Privacy Policy. These Terms apply to all visitors, users, and others who access or use the service.

2. Description of Service

TembusCV is an AI-powered platform that provides the following services:

• •CV Evaluation: Upload your CV and receive detailed, structured feedback including profile overview, experience highlights, skills assessment, education relevance, and overall impression.
• •Job Application Review: Submit a company name, position, and job description alongside your CV to receive a CV-to-job matching analysis, cover letter, and interview preparation guides.
• •Job Search: Configure a weekly automated job search where AI generates keywords, searches job listings, scores results, and emails you the best matches based on your CV and preferences.
• •Interviewer Tools: Interview-oriented output including interview questions with evaluation rubrics, areas to probe, and technical/behavioral interview guides.

3. User Accounts

To use TembusCV, you must create an account. You agree to the following:

• •You must provide accurate, current, and complete information during registration.
• •You are responsible for maintaining the confidentiality of your password and for all activities under your account.
• •You must verify your email address to activate your account.
• •You must notify us immediately of any unauthorized use of your account.
• •We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

You retain full ownership of all content you upload to TembusCV, including CVs and job descriptions. By uploading content, you grant us a limited, non-exclusive license to:

• •Process your CV through our AI evaluation pipeline to generate feedback and analysis.
• •Transmit your content to third-party AI providers (Google Gemini) for processing as described in our Privacy Policy.
• •Store your content temporarily in accordance with our data retention policies.

You represent that you have the right to upload any content you submit and that it does not infringe on any third party's intellectual property rights.

5. AI-Generated Content

You understand and agree that:

• •AI-generated content may contain inaccuracies, biases, or incomplete information.
• •Evaluations and scores are algorithmic assessments and do not represent professional career advice, legal advice, or endorsements.
• •Generated cover letters and interview guides are suggestions and should be reviewed and customized before use.
• •We are not responsible for any decisions you make based on AI-generated content.
• •You should always exercise your own judgment and consult qualified professionals when making career decisions.

6. Job Search & External Links

When using the job search feature, you acknowledge that:

• •Job listings are sourced from third-party search engines and we do not control their content or availability.
• •Job scores and relevance rankings are AI-generated suggestions and may not reflect actual job quality or suitability.
• •External links may lead to websites that are not secure, may contain misleading information, or may be fraudulent.
• •You should independently verify all job opportunities and exercise caution when sharing personal information with third parties.
• •We are not liable for any loss, damage, or harm arising from your interaction with external job listings or third-party websites.

7. Acceptable Use

You agree not to misuse the service. Prohibited activities include:

• •Uploading content that is unlawful, harmful, defamatory, or infringes on others' rights.
• •Attempting to circumvent rate limits, security measures, or access controls.
• •Using automated tools or scripts to access the service beyond its intended use.
• •Creating multiple accounts to abuse the service.
• •Uploading files that contain malware, viruses, or other malicious code.
• •Using the service for any purpose that is illegal or unauthorized.

We enforce rate limits to protect the platform. Violations may result in temporary IP blocking or account suspension.

8. Data Retention

To protect your privacy, TembusCV automatically deletes your data after it is no longer needed:

• •CVs are automatically deleted 30 days after evaluation, unless associated with a job application review.
• •Job application reviews are automatically deleted 30 days after evaluation.
• •Job search runs and evaluations are automatically deleted 30 days after creation.
• •Orphaned files not linked to any record are deleted daily.

You may also manually delete your data at any time through the dashboard once processing is complete.

9. Limitation of Liability

To the fullest extent permitted by applicable law, TembusCV and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• •Loss of profits, data, use, or goodwill arising from your use of the service.
• •Decisions made based on AI-generated evaluations, feedback, or recommendations.
• •Any interactions with third-party job listings, employers, or external websites.
• •Service interruptions, delays, or failures in processing.

10. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

• •The service will be uninterrupted, timely, secure, or error-free.
• •AI-generated results will be accurate, complete, or reliable.
• •Any defects in the service will be corrected.

You use the service at your sole risk.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on this page with a revised "Last updated" date. We encourage you to review these Terms periodically. Your continued use of TembusCV after any changes constitutes your acceptance of the updated Terms.

12. Dispute Resolution; Class Action Waiver

Individual Capacity: You and the Operator agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Class Action Waiver: YOU AND THE OPERATOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and the Operator agree otherwise, no judge or arbitrator may consolidate more than one person's claims with your claims, and may not otherwise preside over any form of a representative or class proceeding.

13. Governing Law and Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the Operator resides, without regard to its conflict of law provisions. You and the Operator agree that any judicial proceeding will be brought exclusively in the courts located in the Operator's country and jurisdiction of residence.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
